Job Description
Are you a bright, ambitious individual from the commercial construction sector? Do you have a QS qualification, or a member of a professional body like CIPS, ideally with a construction or law related degree with experience of preparing and agreeing commercial contractual T&Cs? If so, we have the role for you, offering up to £55k basic, £6k car allowance, 10% bonus and up to 39 days hols including Bank hols, with a market leading fenestration manufacturer. -THE ROLE;
* As Commercial Contracts Manager you will be responsible for the company's commercial and contractual position on all contracts. Your broad range of responsibilities will cover Contract review and compliance, dispute resolution, construction claims, training and reporting to the executive team.
* As Commercial contract manager, you will review the company suite of contracts including commercial partner contracts and ensure all are risk averse, up to date with relevant UK legislation and company governance procedures and aligned across the company's brands.
* This contracts and compliance will include PO Terms and Conditions, Letters of Intent, Collateral Warranties, Vesting Certificates and Performance Bonds.
* As Commercial contracts manager, you will evaluate and risk assess on jobs on non standard terms, ensuring that these remain as close as possible to our clients standard General Conditions of Sale (GCOS)
* You will be responsible for the company's commercial and contractual position on contracts and support the operational teams in the resolution of disputes and claims.
* You will review, negotiate and draft collateral warranties to ensure that it is risk averse.
* You will liaise with sales, project and service coordination teams, with advice on relevant contractual issues.
* You will act as the point of escalation for claims, assess customer claims to ascertain the validity of the claim and provide feedback on the contractual position, attending client meetings to conclude claims and or disputes where necessary.
* You will provide training sessions to all staff on contractual matters across the brands.
* You'll provide monthly management reports on the status of any ongoing legal disputes.
-THE SUCCESSFUL CANDIDATE;
* The ideal CCM will have one of the following; QS qualification (RICS/IOB/other), Membership of a professional body, e.g CIPS or have a Construction or Law related degree or diploma.
* You will have commercial construction industry experience, perhaps having worked for a main or sub contractor or supply only manufacturer.
* You will have experience of preparing and agreeing commercial contractual terms and conditions, along with experience of effective dispute resolution, through negotiation and/or adjudication.
* You would have set up and established commercial procedures, with detailed knowledge of product/installation warranties.
* Experience in the creation of Distribution, Trading, Design, Service, Framework & Approved Installer agreements.
* It would be desirable if you've had previous experience in Quantity surveying in the facade/fenestration/curtain walling industry, along with previous experience of training staff on contractual matters.
* You will have emotional intelligence and the ability to manage conflict effectively.
* You have the ability to break complex subjects down into a language easily understood by colleagues.
* You are a proficient record keeper with excellent time management and task prioritisation.

-THE REMUNERATION;
* £50,000- £55,000 basic salary, depending of experience.
* Additional company and performance related bonus potential of 10% of salary.
* £6,000 per annum car allowance.
